    Title: 物權法定主義鬆動下的民事財產權體系－再探大陸民法典的可能性－

    Abstract: 大陸現階段投入民法典立法的努力,主要當然是著眼於如何回應市場經濟發展的需要。但無論從它將成為世界最大經濟體的現實角度,或它的民事法制是在一個相當初階的實定法基礎上全盤重建來看,嘗試一些新的可能性,乃至引導某些新的發展,毋寧都是很自然的想法。對大陸民法學者而言,這當然是極大的挑戰。這篇文章延續去年這個時候所做的對於民法典的整體思考,在基本上肯定了民法典的時代意義以後,進一步對於決定法典體例最關鍵的民事財產權體系,提出一些補充的看法。筆者認為,物權法定主義是導致許多重要民法典在體例上把債與物分開規範最主要的前提決定,因此當物權法定主義在台灣的理論與實踐,一如某些國家,已經開始鬆動以後,對於大陸民法典的體例如何建構,應該有一定的參考價值。因此本文第一節先對這個民法政策重新作一番檢視,第二節以台灣物權法的發展為例,觀察鬆動的現象和原因,第三節再從一個新財產權體系出發,對大陸民法典的體例提出一些不同的思考。
