    Abstract: 按民法第769條、第770條分別規定：「以所有之意思，二十年間和平、公然、繼續占有他人未登記之不動產者，得請求登記為所有人。」「以所有之意思，十年間和平、公然、繼續占有他人未登記之不動產，而其占有之始為善意並無過失者，得請求登記為所有人。」另，第772條規定：「前五條之規定，於所有權以外財產權之取得，準用之。於已登記之不動產，亦同。」準此，所有權以外之不動產物權，亦得基於時效而取得。惟占有人於取得時效完成後，僅取得登記請求權，需經辦竣登記始能取得物權1。而有關時效取得所有權以外之不動產物權，於實務上較為常見者，乃為時效取得普通地上權（民法832）。是本期選錄最高行政法院108年度判字第406號判決等4則關於申辦時效取得地上權登記事件之行政判決，綜合解說其重點及相關事項，以供參考。
