    Abstract: 按民法第769條、第770條分別規定:「以所有之意思,二十年間和平、公然、繼續占有他人未登記之不動產者,得請求登記為所有人。」「以所有之意思,十年間和平、公然、繼續占有他人未登記之不動產,而其占有之始為善意並無過失者,得請求登記為所有人。」另,第772條規定:「前五條之規定,於所有權以外財產權之取得,準用之。於已登記之不動產,亦同。」準此,所有權以外之不動產物權,亦得基於時效而取得。惟占有人於取得時效完成後,僅取得登記請求權,需經辦竣登記始能取得物權1。而有關時效取得所有權以外之不動產物權,於實務上較為常見者,乃為時效取得普通地上權(民法832)。是本期選錄最高行政法院108年度判字第406號判決等4則關於申辦時效取得地上權登記事件之行政判決,綜合解說其重點及相關事項,以供參考。
