Abstract:	依一九八七年兩岸重啟民間交流之門後，跨海聯姻的案例數量逐年增加，政府基於人道考量，自一九九二年起開放大陸配偶來台，然而這些大陸配偶在台灣地區的法律地位不明，其權利應如何保障的爭議也層出不窮。本文以探討大陸配偶在台所受待遇之是否符合平等原則為題，首先由我國憲法規範意旨釐清大陸地區人民在我國之法律地位，再根據其法律定位，分別視具體所涉之基本權利性質為何，檢驗立法者對來台大陸配偶之基本權利保障為不同於台灣地區人民或外國人之差別待遇，是否為基於重要本質要素差異所為之差別待遇，並且檢討差別待遇的合理性。
