Abstract:	大法官於釋字第690號解釋認定基於傳染病防治所實施的強制隔離處置，雖非由法院決定，並無違反憲法第8條之規定。本文以探討強制隔離措施之作成應遵循何等之法律程序——尤其是否應採法官保留，以防止恣意拘禁的發生為研究主題，藉由分析歐洲人權公約第5條規定及歐洲人權法院之相關裁判，作為我國建構強制隔離措施之正當法律程序，與具體化法院審查防疫強制隔離措施合法性時適用之審查標準與密度的參考。並且以歐洲人權公約及人權法院就防疫隔離措施所建構之審查標準與程序要求之研究結果為基礎，反思我國釋字第690號解釋之妥當性。
