    Abstract: 新冠肺炎（COVID-19）疫情大流行形成全球公共衛生緊急事件，安全有效的疫苗被視為解決新冠疫情危機的一項重要方案。歐盟鑑於2021年第一季疫苗供應嚴重短缺，乃於2021年1月30日採取疫苗出口管制措施，引起世界衛生組織（WHO）及其他國家嚴重關切。歐盟出口管制被批評為一種疫苗民族主義，會加重及延長開發中國家的疫情，也不利於全球經濟之復甦。本文將研析疫苗的功能、歐盟疫苗出口管制的原因及背景、法律依據、延伸的爭端與影響。另外，針對歐盟疫苗策略、緊急財務支持、疫苗選擇標準、預先購買協議（APA）、COVAX疫苗全球獲取機制以及WTO疫苗專利豁免等重要議題，從事分析。歐盟疫苗出口管制涉及上述諸多議題，乃是一項具有健康必要性、政治敏感性、法律複雜性、經濟與社會重要性之議題，值得重視。
