Abstract:	於單獨繼承之場合,繼承人對被繼承人負有債務者,繼承之結果,債權債務同歸於一人,因混同而消滅(民法三四四)。惟於共同繼承之場合,被繼承人對繼承人之債權,由共同繼承人共同繼承,形成債權之準共有關係,並不生混同之結果,此時,對被繼承人負有債務之繼承人,身兼債務人及債權準共有人之雙重身分,於遺產分割之際,若無特別規定,將使遺產之分割複雜難行。為方便遺產分割之實行,也為期共同繼承人間之公平,民法乃規定,繼承人中,如對於被繼承人負有債務者,於遺產分割時,應按其債務數額,由該繼承人之應繼分內扣還(民法一一七二)。
