Title:	民法繼承編:第八講無人承認之繼承

Abstract:	我國民法第一一四七條規定繼承因被繼承人死亡而開始,再依民法第一一四八條規定,繼承人自繼承開始時承受被繼承人財產上一切之權利義務。民法採當然繼承主義與包括繼承主義,其主要目的,即在於避免因人之死亡而產生無主物之問題,惟繼承人有無不明或顯無繼承人時,為避免遺產成為無主物,乃需有一套制度加以規範。詳言之,繼承人有無不明時,如將遺產放置不管,則被繼承人之遺產恐有毀損滅失之虞,對日後即將出現而承認繼承之繼承人而言,自屬不利。反之,繼承人若始終不出現,則對於繼承債權人及受遺贈人亦有損害。
