    Title: 從當前WTO上訴機構危機論該機構續存的必要性
    A Study on the Necessity of Saving the Appellate Body under WTO Dispute Settlement Mechanism from the Perspective of Current WTO Appellate Body Crisis

    Abstract: 世界貿易組織(World Trade Organization, WTO)的爭端解決機制向來享有「皇冠之珠」的盛名,如今美國持續杯葛上訴機構成員之任命,致使WTO常設上訴機構停擺,諸多小組報告上訴無效而未能解決爭端。上訴機構停擺對爭端解決機制產生莫大的衝擊,諸多實務界人士及學者相繼提出可能的解決方案,綜觀各種方案,大致可分為二類:力圖修復癱瘓的上訴機構、以及以替代方案取代上訴機構。美國近期的提案似乎亦反映其有意廢除上訴機構,並回歸一審制。然而,究竟應修復上訴機構抑或是廢除上訴機構,本文認為各界在研擬上訴機構因應方案時,得以先反思上訴機構續存的必要性。
    本文藉由探討上訴機構是否達成其於烏拉圭回合之成立目的,檢視上訴機構續存的必要性。然而,若僅以上訴機構是否達成初始成立目的檢視上訴機構續存的必要性,可能不足以因應眼前上訴機構成員選任危機,因美國杯葛上訴機構的原因顯然是上訴機構並未符合其對爭端解決機制的期待,故本文進一步檢視上訴機構符合會員爭端解決機制期待的程度,以綜合評估上訴機構續存的必要性。最後本文認為倘若會員同意廢除上訴機構,則「多邊暫行上訴仲裁安排(Multi-party Interim Appeal Arbitration Arrangement)」作為上訴機構的臨時替代機制於WTO框架下的定位亦值得省思。
    The dispute settlement system of the World Trade Organization (WTO) has been described as the "jewel in the crown". However, the United States` blockage of appointments to the WTO Appellate Body plunged the dispute settlement system into paralysis, which has led to some panel reports being appealed “into the void” and leaving the dispute unresolved. Some trade practitioners and scholars have proposed various solutions to the Appellate Body Crisis. These solutions can be divided into two types: save the WTO Appellate Body or abolish the WTO Appellate Body. In recent discussions, the United States appears determined to reduce the WTO’s two-tier dispute settlement system to a single-tier body. In an attempt to decide on the appropriate solution to the Appellate Body Crisis, it is crucial for all of us to consider the need of saving the Appellate Body.
    Therefore, this article aims at examining the necessity of saving the WTO Appellate Body by assessing whether it has stopped “bad” panel reports from becoming legally binding. However, focusing solely on the purpose of establishment during the Uruguay Round might not sufficiently address the current Appellate Body crisis. The United State blocked the appointments to the Appellate Body due to Appellate Body’s failure to meet its expectations regarding the dispute settlement system. Therefore, we further examine whether the Appellate Body has met the expectations of WTO Members. Finally, assume that WTO Members agree on the abolishment of the WTO appellate body, the Multi-party Interim Appeal Arbitration Arrangement, as an interim mechanism to substitute the functions of the Appellate Body, may become the next issue unresolved.
