Title:	從道德危險到公序良俗—人身保險利益規範目的與解釋論之省思

Abstract:	實務與學說上向來認為人身保險利益是人身保險契約的生效要件之一。為避免道德危險及防止以他人生命賭博，對於被保險人無保險法第 16 條規定之保險利益者，不得為其訂立保險契約；欠缺保險利益之人身保險契約無效。但傳統見解把保險法第 16 條的人身保險利益解釋為列舉性質的強制規定，排除其他關係亦可做為人身保險利益的可能性，也將限制他人為被保險人投保的機會，不論是從推定其存在道德危險或推定其係以他人生命賭博，均非妥當。比較法上採取保險利益原則的國家，已有逐漸鬆綁人身保險利益的認定，或甚至放棄人身保險利益作為保險契約生效要件的趨勢。法律解釋論上，宜將人身保險利益的規定解釋為例示性的注意規定，承認其他具有一定利害關係之人亦得為被保險人投保人身保險。至於與被保險人不具一定關係，卻以其生命投保人身保險的情況，若實質上屬於以他人生命賭博的性質，仍得以公序良俗管制之。
