    Title: 海上責任保險之研究

    Abstract: 目前國內關於海上責任保險之專論，仍多傾向於介紹特定性質之防護與補償保險協會，例如船舶所有人相互保險協會，其對於特定協會之承保範圍之說明，居功厥偉，但頗有見木不見林之憾。本文試圖以較宏觀之思維，勾勒出海上責任保險之梗概，以供學界及業界參考。
    由於法律責任之發生必有其歸屬者，因此本論文之主要結構將以海上活動主體為標準分成三章：其一為一般船舶所有人，其二為傭船人，其三則為貨物承攬運送人。各章之首，必先釐清其主體之性質與法律地位，兼之比較與其類似之活動主體之差異；其次論述該等活動主體所可能面臨之民事責任風險；最後，則說明相關保險協會之承保範圍。
    就所參酌之相關協會之承保規則而言，由於一 般船舶所有人組成之協會數量最多，為顧及我國實務界之運作，因此以我國航運界較為熟悉之三家協會--「不列顛輪船保險協會」(The Britannia Steam Ship Insurance Association Ltd.)、「聯合王國輪船相互保險協會」(The United Kingdom Mutual Steamship Assurance Association Ltd.)以及「挪威嘉得船舶所有人責任相互保險協會」(Assuranceforeningen－Gard)--所制訂之承保規則為研究對象；而傭船人及貨物承攬運送人部份，則各以「傭船人相互保險協會」(The Charterers Mutual Assurance Association Limited )及「一貫運輸相互保險協會」(Through Transport Mutual Insurance Association Limited)所制訂之承保規則為研究對象。
