Abstract:	公平交易法身為規範所有經濟交易行為之「經濟憲法」，對我國產業環境、企業經營對策均有深遠影響，並替法學與經濟學拓展了良好之對話平台。但自其民國八十一年二月四日實施迄今，仍欠缺一套完整、詳密且有系統之註釋書，彙整近十二年來所累積的豐富案例與學術見解，以供作學術與實務界參考。為使國內能夠對於公平交易法十多年來的適用狀況有一全面性的瞭解，並以此基礎進一步地驗證競爭法規與產業、經濟發展之互動關係，且掌握相關學說及實務見解，及其相互間之關連性，並評述其得失，仿照外國進行註釋公平交易法之研究工作，誠有必要。因此，公平交易法之註釋研究系列，即意欲全方面彙整公平交易法目前學說、案例與實務見解之研究成果，開展國內尚未起步然在國外競爭法研究領域中甚為重要之註釋書研究工作，以作為未來我國競爭法發展之基石。而第一階段-公平交易法之註釋研究（一）-係以公平交易法第一條至第十七條（即第一章總則以及第二章關於獨占、結合、聯合行為等限制競爭行為之規範為研究範圍），已於九十二年十二月完成。至於本研究之第二階段-公平交易法之註釋研究（二）-則接續註釋公平交易法第十八條至第二十四條，亦即第三章不公平競爭行為為範圍。
