Title:	我國實施勞動契約法制影響評估研究

Abstract:	在針對勞動契約相關法制之現行法與未來法為研究客體之下，以台灣暨相關國家法律規範之解釋、修正與形成為經，兼及所可能造成之現實勞動生活變動與影響之緯，本研究嚐試整合勞動法釋義學體系、法解釋論、法政策暨立法論，乃至法社會學之實證考察觀點，希望能具體描繪出我國未來勞動契約法制之藍圖。在前述研究主旨下，本研究之核心主旨暨內容應包含下列各項：（1）整理並分析國內實務上之勞動契約態樣，特別是數種重要類型之非典型勞動，以及其等在現行勞動法令上所呈現之問題。（2）在前述之分析基礎上，梳理出勞動法釋義學論與法政策立法論上之重要面向與問題。（3）研究相關國家近年來重要之勞動契約法制改革，兼及其改革背景、政策思維與影響評估，篩檢出於我國能有意義之經驗啟示。（4）提出我國勞動契約法制之未來法芻議與藍圖，包括具體之法政策建議。（5）在前述之未來勞動契約法制結構基礎上，同時提出對產業經濟與勞資關係之影響。
