Abstract:	憲法是人民基本權保障者，其中以言論自由及出版自由為主軸的表意自由更是現代民主國家的基石。我國政治解嚴後，開放黨禁、報禁形成百花齊放，百家爭鳴的景觀，由狂飆式的民主演變為成熟式的民主，並且在尊重人權，維繫法制綱領下亦步亦趨的摸索前進。本書透過對我國司法院大法官表意自由多號解釋之分析，試圖建構一套清晰多元、民主、活潑的法治秩序。本作者法治斌教授長年觀察大法官對表意自由釋憲學理發展與建構，厚植對表意自由理論與實務的剖析能力。法教授後被提名為大法官，但在立法院行使同意權的前夕，因心肌梗塞辭世。這本論著法教授為我國表意自由的發揚與保障作出了最偉大的貢獻。
