Abstract:	本書作者在書中透過分析中國傳統法制的色與內涵，嘗試探討的是，究竟傳統中國法律體制在近百年來趨於沒落的發展，是任何法律體制的共同命運呢？亦或是他獨特的命運？作者認為，惟有透過法制史的研究，可以讓我們從歷史經驗中，學習並對現有的法律體制重新思考或設計。作者嘗試從個人、家庭、婚姻與國家的關係，論述傳統中國法律，如何透過規範，使得人民必須接受三綱五倫的生命價值。
