    Abstract: 本書內容大致可區分為民事實體法與民事程序法二大領域。民事實體法領域包含二部分，一為日常生活中常見之消費爭議問題，內容有分時享有（渡假村）契約、融資貸款及信用卡冒用風險；另一為與國人息息相關之保證契約，包括連帶保證及人事保證。而民事程序法部分則特別針對訴訟標的理論及各種特殊類型之舉證責任深入研究探討。對於上述爭議問題，作者主要以實務判決為評析內容，參酌國內學說及德國立法例、最新學術見解，指出爭議所在，並進行闡述分析，且提出作者個人研究與教學之心得，以期釐清當今實務爭議問題，並提供一解決之道。
