Abstract:	教育事務經緯萬端，無法避免權力之糾葛與角力。教育行政機關、校長、教師、家長、社區與其他教育利益團體，彼此之間常因立場不同而頻生衝突。其中如父母教育選擇權、學生受教權、教師聘任、學校侵權行為等，實務上皆產生重大爭辯。他山之石，可以攻錯。本書即以美國教育法與判例為焦點，敘述並分析在重大教育議題上，美國聯邦與州各級法院的判決與主張。許多至今仍迭有爭議的課題如教師解聘、學生言論自由、體罰、搜索等，本書均有深入之探討。全書參閱上千件美國法院判例，經統整後加以呈現，為華文世界相關美國教育法的先驅之作。美國雖屬英美法系國家，但其教育法與判例卻能提供許多教育啟示。藉由本書，盼能激發不同層次的思維，進而對未來教育之建構有所助益。
