Abstract:	我國上訴審制度，從民國二十四年現行刑事訴訟法制定以來，至今已歷六十六年，其間並無重大之修正，大致維持制定之初之原貌。不過，由於上訴案件日益增加，無論是第二審高等法院或第三審最高法院，近年來已面臨案件過多，工作負擔已達飽和之狀態，因而對上訴審改革之呼聲甚囂塵上；再加上目前新興之(刑事)司法改革之熱潮，對於第一審訴訟程序之變革，必然導致上訴審程序之改變，因而對上訴審程序之全面檢討，似已成為當前刑事司法不得不面對之課題。 Rechtszugsystem nimmt Einfluss auf die zwei Institutionen im Strafprozess: die Rechtsmittel und die sachliche Zustaendigkeit. Die jetztige Regelung der sachlichen Zustaendigkeit ist deswegen tot, weil die zur sachlichen Zustaendigkeit gehoerten Straf sachen zu eng beschraenkt ist. Diese Vorschrift bedarf einer erweiternden Reform. Ausserdem sollte die Rechtsmittel auch die Besezung des Strafgerichts beruecksichtigen. Die Konzeption der vorstehenden Strafprozessrefom sollte das auslaendige Strafprozessgesetz nicht woertlich einfuehren, sondern nach dem Sinn umformulieren.
