Title:	都巿更新條例施行細則草案之研究

Abstract:	由於以"權利變換"方式進行都市更新工作, 涉及政府的行政程序作業與人民財產權之調整分配,此皆為法制化時所不可輕忽之重點.因此, 擬藉本研究以建立"程序正義"與"財產權公平" 原則,以為權利變換辦法法制化之基礎,從而研擬權利變換辦法草案,以為本研究之主要目的所在.本研究之研究目的可分述如下:(1)經由本研究,瞭解相關國家執行"權利變換"方式進行都市更新之實際作業程序,並分析其可供我建立法制之參酌要點;(2)檢討現行我國進行都市更新作業所面臨之困境及實施過程,以為擬定法制之參考;(3)構建實施權利變換辦法之基本立法原則,並研擬權利變換實施辦法草案,以期建立完整之都市更新制度.
