Title:	徐自強擄人勒贖殺人案評析－評最高法院九十二年度臺非字第二四二號等相關判決

Abstract:	"日本在憲法上雖設有地方自治保障規定,但實際上地方分權‧地方自治法制度及實況,長年來卻存續著以「機關委任事務」(Organleihe)為象徵代表的中央集權的政治‧行政體制。而關於中央與自治體間之關係,仍然與大日本帝國憲法(明治憲法)一樣,即係在中央強烈監督支配下之「上下‧主從」關係,中央的干預法制及得稱為中央與自治體間的爭訟制度,幾乎不存在,僅存有機關委任事務之職務執行命令訴訟制度而已。而且這種職務執行命令訴訟制度,也只不過是以中央對機關委任事務之包括性的指揮監督權為前提之偏頗的制度而已,並非保障自治體自治權之救濟制度。甚且,實際上自治體幾乎是服從中央之干預,此制度乃幾乎未曾使用。"
