Abstract:	" ""國外立法例就產品以外,對於瑕疵服務責任作一般性規範之嘗試,僅見於歐體執委會所訂之瑕疵服務責任歐體準則草案(Proposed Directive on Liability for Defec-tive Services2,簡稱「服務準則」。服務準則第二條(服務之定義)規定:「本準則稱服務,指以商業基礎或以公共服務或以獨立方式,所為之交易,不論其有無對價(re-turn for payment),而其直接及全部之標的,並非動產之製造、有體或無體財產權之移轉者。本準則不適用於維持公共安全之公共服務。對於包裹旅遊(package travel,指食宿交通在內者),或廢棄物品之服務,亦不適用。"" 起訖頁 132-134 "
