本計畫之目的，在於探討美國反傾銷制度中產業損害及因果關係認定問題。本計畫分別針對農業、傳統產業及非市場經濟國家進行之反傾銷案件，就基礎事實與法律事實加以整理分析，並根據「實質損害成立」、「有實質損害之虞」及「實質損害不成立」等案件類型分析、歸納其推導產業損害及其因果關係認定時所考量之因素及其推論之各種型態。 The purpose of this project is to investigate the issues related to industry injury and causality determination in the American antidumping practice. The antidumping cases concerning the agricultural products, traditional industries as well as non-market economies are analyzed. Different types of cases, according to investigation results such as "materially injured", "threatened with material injury" and "not materially injured", are analyzed and compared with each other. The key factors and the arguments distinguishing these cases in the determination of industry injury and causality are identified.
