Abstract:	公有非公用土地為政府重要資產之一,其開發是否符合經濟效率,不僅是政府部門對公產經營管理績效的表徵,關係到財政收入,更會影響到土地市場運作的效率。依公有土地經營及處理原則規定,公有非公用土地之開發,除了由管理機關自行辦理外,得依下列方式為之:設定地上權方式、委託方式、合作方式及聯合方式。惟公有非公用土地應選擇那種開發方式,不僅關係到開發經濟效率更隱含公平問題。對公平面的影響是因為不同的開發方式代表著不同契約型態,而不同契約型態對於契約訂定雙方之責任義務與利益分配也不盡相同,所以契約選擇存在公平問題;至於土地開發經濟效率問題則來自於土地的異質性,因為異質性的存在,使得契約的訂定涉及協商,政府部門如何選擇最合適之契約型態使得開發商參與公有非公用土地開發之協商成本或時間成本,以及政府部門執行土地開發之契約審核成本及監督成本達到最低,便是經濟效率。
