    Abstract: 在我國由民主轉型至民主鞏固的變遷過程之中,文官體制的行政倫理是攸關行政改革是否成功的關鍵議題之一。緣此,本研究計畫將針對以下三項問題加以探討:一、行政倫理的具體內容與操作意義為何?二、現今先進國家有關行政倫理的法律規範與機制設計為何?三、如何在我國現階段的行政改革進程之中,規劃出較為合宜的倫理機制與運作程序?要言之,本研究計畫之主要目的乃是探討我國行政倫理的制度化之道,期能落實改革理念,以達成政府廉能之效。本研究計畫輔以文獻分析法、比較研究法、法制研究法、焦點團體法以及深度訪談法,預計以兩年為期,由建立公務人員利益衝突的迴避規範;強化財產申報規定;恪遵行政/政治中立原則;制定「政府倫理法」;增訂「揭發弊案保護法」、健全行政倫理的教育訓練體制,與設置「公務人員倫理委員會」等數個面向,深入探討我國行政倫理制度化的議題,與提出具體作法。
    The administrative ethics is the key issue in determining the success of administrative reform during the transition from democratization to democratic consolidation. This research will explore on the following three issues: 1. What are the specific content and the meaning of operation of administrative ethics? 2. What are the legal norms and institutional deigns regarding the administrative ethics of other advanced countries? 3. How to design the ethical mechanism and operational procedures at the current stage of administrative reform process in Taiwan? The purpose of this research project is to discuss the institutionalization of administrative ethics in Taiwan in the hopes of upholding the beliefs and maintaining the integrity, efficiency, and convenience of the government, in order to ensure that Taiwan sustains the advantages in globalized competition. The literature analysis, comparative study, legal researchfocused-groupresearch, and in-depth interviews are employed and conducted in this project. It is anticipated that the issues of institutionalization of administrative ethics in Taiwan will be investigated, on a basis of 2 years, from several aspects: establishment of civil servant norms to avoid conflict of interests; reinforcement of property declaration rules; abidance of the administrative/political neutrality principles; stipulation of “Government Ethical Act”; update of “Whistle Blowing Protection Act”; and design of education training system for administrative ethics, and establishment of “Public Service Ethical Committee.”
