    Abstract: 我國的集水區治理,因權責分散、缺乏區域整合及在地參與的機制,常有成效不彰的問題;同時,由於資源治理機關目標過於單一化,往往未考慮原住民部落之發展需求,造成族群之間的環境不正義。以石門水庫上游集水區為例,早年因為水庫興建而強制遷村造成淹沒區原住民部落失散流離,未遷村的部落則因集水區的管理而受到各項的限制;晚近因為水庫淤積日增,山區原住民部落的耕作和土地利用對水資源的影響成為受矚目的焦點。雖然政府的石門水庫集水區整治計畫中定有保留地復育的項目,對保留地的違規使用進行舉報,但始終缺乏從部落發展的角度進行思考之整合性資源治理政策。因此,本研究目的,冀藉實證研究提出以部落為基礎單位,設計流域整合之多目標資源治理模式,及兼顧永續發展與環境正義原則之原住民族土地政策。目前,我國的原住民政策的法制架構正因原住民族基本法等法律的逐漸完成而面臨重大的調整,未來我國集水區之治理之成效,將與原住民族土地政策有更直接而密切的關係。故本研究將以深度訪談、焦點團體及參與式觀察等研究方法進行泰雅族部落田野調查,並結合傳統生態知識、社區自然資源管理、跨尺度網絡理論等分析工具,探討這些部落的土地資源使用的經濟性/非經濟活動,以及支持這些使用方式的社會組織和土地觀,藉以從在地的觀點釐清部落發展之確切需求,並分析與研究區域相關的土地資源制度和政策對於部落的資源利用之激勵與限制結構。最後,本研究將權衡資源管理之跨尺度需求與目標,以及原住民保留地與傳統領域之法制架構,就部落為基礎的資源管理制度提出具體政策建議。
    In lack of mechanism for regional integration and community participation, the watershed management in Taiwan use to be disorganized and inefficient. Meanwhile, even though most of the watersheds of reservoirs are located in the mountain indigenous areas, the needs of the development of indigenous communities are not well considered. It leads to the issue of environmental injustice. For example, the construction of Shih-Men Reservoir in 1950s enforcedly displaced certain Atayal indigenous communities and the regulations for the management of its watershed continually confined the other communities in this area. The increasing sediment in this reservoir has attracted governmental concerns to the land use activities in indigenous communities in recent years. Therefore, the purpose of this study is to propose an indigenous land policy for community based, regional integrated and multiple purposed watershed management which can meet the principles of sustainable development and environmental justice. However, no integrated resource management policy was made in the aspect of indigenous community development. The only measure implemented was to enforce the report of illegal Indigenous Reserved Land farming. Aiming to propose the institutional design that can balance both the goals of indigenous community development and watershed conservation, and response to gradually changing legal infrastructure for indigenous autonomy since the pass of Indigenous Basic Law, this study will conduct a two-year fieldwork in the Atayal communities in the Takazin and Sakayazin River Valleys, which is just the watershed of the river runs to Shih-Men Reservoir. This study will explore: 1) the land/resource using activities and both the social conditions and eco-philosophy supporting these activities; 2) the needs of community development in indigenous perspectives; 3) the incentive/restrictive structure made by resource policies and regulations related to this area. In the end, this study will analyze the needs and goals for resource management in different scales, scrutinize the regal infrastructure of Indigenous Reserved Land and Traditional Territory, and make concrete suggestions to the institutional construction of community based watershed management. The methods for information collection will include in-depth interview, focus group and participatory observation. The theoretical tools applied will include the theories of traditional ecological knowledge, community based resource management and multi-scale network analysis
