    Abstract: 於我國現行土地登記法制下,學說上大多認為登記機關對於登記申請案件之審查權限是採實質審查主義。但問題是,關於登記審查之規定,日本與我國有類似之規定;而何以日本學說上認為其登記機關之審查權限是採形式審查主義?申言之,我國關於土地登記之申請,依規定應提出法定文件及書類。另外,雖登記機關依法有依職權調查證據之權,而不受當事人主張之拘束,且登記機關基於調查事實及證據之必要,得以書面通知相關之人陳述意見;儘管如此,但基於法律保留原則,登記機關即不應要求登記申請人提出法定文件書類以外之文件。於是,登記機關於受理登記申請案件之後,則僅能就法令所定登記申請人應提出之文件範圍進行審查。而此等情事,與申請人初步理解之日本登記機關審查人員之審查權限似無二致。若是如此,何以謂日本於不動產權利之登記上,係採形式審查主義;相對地,我國卻多認為係採實質審查主義?此實有再行深入釐清之必要。緣此,本研究擬從學理角度對於土地登記法制之基礎性問題,亦即土地登記機關審查權限之法律議題進行探討。申言之,擬藉由對於日本土地登記法制上關於登記機關審查權限相關理論與實踐之實態予以翔實解析,並以此為基礎,與我國登記機關之審查權限相關法律議題為比較分析,以釐清前述之質疑
    A Comparative Study on the system of Land registration between Japan and Taiwan -- Focus on Examination Rights of Registration Authority and Related Legal Issues. By the current land registration law in Taiwan, most theories claim the application for registration of the registration authority for permission to examination the case of the substantive examination principle is taken. But the problem is that Japan and Taiwan’s Registration examination of the regulations is similar. Why Japan’s theories claim the application for registration of the registration authority for permission of the formal examination principle is taken in Japan? There are necessary to clarify. While Taiwan’s legal system of land registration is need to review and improve, this paper will study those basic questions on the system of Land registration by the theoretical view, discussing the legal issues of examination rights of Registration authority. Furthermore, Base on detailed analysis the Japan’s legal system of land registration authority on the registration authority has reviewed the theory and practice, comparative study about the examination rights of registration authority and related Legal Issues, to clarify the above questions
