Abstract:	行政院根據「科學技術基本法」第六條第二項之規定，1 委託國家科學委員會於八十九年二月二十五日公佈「政府科學技術研究發展成果歸屬及應用辦法」。2 該辦法將政府出資委託、補助、資助計畫之研究成果原則上歸屬於計畫執行單位所有，並由其負管理及運用之責，而資助機關享有介入權（March-In）與無價、全球、非專屬及不可讓與之實施權利。該辦法對於研發之收益按機構性質的不同須繳交其中20-50%與資助機構。而所謂科學技術研究發展成果乃指政府機關編列科技計畫預算，補助、委辦或出資進行科學技術研究發展計畫獲得之智慧財產權或成果。其研發成果收入，指資助機關、研究機構或企業因管理及運用研發成果所獲得之授權金、權利金、價金、股權或其他權益。
