    Abstract: 公平交易法第二十四條為我國競爭法上最完整而重要的概括條款，實務也累積了龐大的案例數量，近年來甚至躍居成為公平會用以處分案例之第一位，其實務意義不言可喻。在實務累積了龐大的案例數量之後，對於構成要件如此抽像概括的本條而言，實有必要建立一個合理的案例體系，以利其操作。類型化與體系化之工作，不但有助於對本條的理解，使公平交易委員會、法院與事業均能夠掌握其全貌，也能指導未來具體個案之法律適用，建立事業競爭與市場行為的具體規範，促進法律的安定性與可預見性，更具有控制概括條款之適用範圍，避免其過度擴張之作用。本計畫即嘗試從學理、比較法、公平會及法院實務之發展，提出一套適合於我國公平法第二十四條操作之案例類型體系，並對實務上數量龐大之個別案例所構成之行為類型，進行進一步之探討研究。只有藉由對公平法第二十四條概括條款具體案型（如高度抄襲、濫發警告信函、濫用相對市場優勢地位.等）做深入之分析，始可釐清本條與其他法律以及其與公平法其他各條的補充關係，並指出過去執法可能的缺失，以供理論與實務參酌。此一工作，實為進一步推動我國競爭法精緻化不可或缺之步驟。其研究成果，也能使受規範的事業有具體明確的規範基準，以資遵循。
