    Abstract: 由於國內眾多學者的引進與介紹，客觀歸責理論已經成為近年來國內刑法學界熱門的研究主題。惟其中研究涉獵的範圍多是聚焦於客觀歸責理論之下位概念內涵的闡釋，例如：風險製造、風險實現以及構成要件效力範圍的判斷原則等等。基本上，相關研究對於客觀歸責理論的認識，正如客觀歸責理論的出發思考，主要是為了區隔「不法」與「不幸」的界線，換句話說，只有在具體個案中行為人的行為所造成的結果是不法結果（可歸責）而非意外的因果歷程所牽動不幸事件時，始得使其負擔刑事責任（此即Honig所提倡的「客觀目的性」概念）。國內學說因此大都認為若依客觀歸責的原始目的加以觀察，則客觀歸責理論只能適用在結果犯，事實上Roxin在其刑法總則的著作論述中，也認為結果原因的存在是結果歸責的前提要件。然而，客觀歸責理論的功能究竟是否必須如其原始目的，只限於結果犯的檢驗，似乎在風險概念被廣泛的應用後，出現有動搖有的空間，特別是客觀歸責理論的價值核心內涵被純粹理解為：一種對應於普遍的社會期待之價值思考時，其實已經將客觀歸責理論的核心思考推向一個尚未開拓新領域。如果行為人的行為沒有違反社會的價值期待，甚至對其處罰亦不生一般預防的目的時，則行為的應刑罰性是否存在，確實值得討論。
