    Abstract: 債權之價值不在其數額，而在於債務人之清償能力。因此，債權人之擔保為債權人追求之目標。民法關於債權之擔保權利雖涉有不同種類之類型，如抵押權、質權、保證債權等，並因其擔保權利之目的，法律乃設有從屬性之規定，使法定擔保權利在成立上、範圍上、讓與時與消滅或行使權利時均從屬於主債權。惟社會交易型態上發展出更具擔保功能之約定擔保權利，如保證附立即照付約款、基於擔保目的而為之給付如工程契約之履約保證擔保金、租賃契約之押租金等約定不同類型擔保權利。此外，亦有衝撞物權法定主義之最高限額抵押等。上開約定之新興擔保方式均面臨如何避免分歧解釋，法律適用雜亂之困境。因此，藉由國內學說及實務見解之類型化整理，以及德國、甚或是歐盟國家成熟且完整之擔保權利制度之研究，正足以提供我國不同類型擔保權利在解釋適用上供理論建構與實務爭議問題解決方式之參考，併力求兼顧債務人之擔保需求與債務人權益之保障，且彌平有擔保債權人與無擔保債權人間不平等地位之結構缺陷。
