    Abstract: 我國涉外民事法律適用法係仿六十年前日本之法例(國際私法)而來,自民國四十二年施行以來,至今已逾五十年,其中部分之規定,例如關於婚姻之效力、夫妻財產制、離婚原因及離婚效力等之準據法則係採夫之本國法主義,明顯違反男女平等原則,為此,涉外民事法律適用法關於此等規定實有修正之必要。日本平成元年,針對該國法例(國際私法)關於違反男女平等之規定均已做大幅度之修正,日本法例修正之經驗及其內容值得參考。本研究計畫擬透過比較法之研究,參考日本之修正經驗,以提供我國涉外民事法律適用法之修法方向。本研究計畫,首先究明國際身份法與兩性平等之關係後,再就婚姻之效力、夫妻財產制、離婚原因、離婚效力等之準據法修正方向加以檢討,最後並提出修正意見。其具體之研究內容如下:一、國際身份法與兩性平等之關係二、婚姻效力準據法之修法方向三、夫妻財產制準據法之修法方向四、離婚原因準據法之修法方向五、離婚效力準據法之修法方向。
    Following and imitating the Japan law (i.e., International Private Law) enforced 60 years ago, Application Law Concerning the Governing Law of Foreign-related Civil Affairs (「Application Law」) in our country was promulgated and enacted in 1953 and has been in use for more than 50 years since its enactment. Articles of the Application Law concerning the governing laws of the validity of marriage, matrimonial property regime, cause to divorce and validity of divorce, among others, were legislated in accordance with the traditional domestic law principles for husband』s advantages and therefore bias in nature. Such articles are in clear violation to gender equality and thus need significant amendments. In 1989, articles in violation to gender equality of the Japan Law (i.e., International Private Law) were greatly amended, and the experience and amendments of such a law reform are worth our reference. This Project, using the comparative law approach, intends to refer to the aforesaid law reform to provide directions and guidelines to Application Law amendments for our country. This Project first clarifies the relevance of the international family law and gender equality, followed by a close examination of the current articles which concern the governing laws for the validity of marriage, matrimonial property regime, cause to divorce and validity of divorce, and provides suggestions for amendments. Specifics are as follow: 1. Relevance of the International Family Law and Gender Equality; 2. Amendment Directions for Governing Law of Marriage Validity; 3. Amendment Directions for Governing Law of Matrimonial Property Regime; 4. Amendment Directions for Governing Law of Cause to Divorce; and 5. Amendment Directions for Governing Law of cause to Validity of Divorce.
