    摘要: 國民政府最高法院各該年份的民刑事判例，雖曾刊行要旨，但缺漏全文，既無基本事實之客觀呈現，亦乏完整之論證理路，非但學術上無從深入探索，司法實務運作上亦祇知其然，而不知其所以然。本研究計畫之主要目的，即在蒐集散逸在海內外各處之最高法院民刑事判例全文，並加予整編、校注，以重建國民政府時期，民刑事審判實務中，各項法律見解形成的完整事實脈絡，以及法律適用的邏輯運作過程，俾能提供學術界相關研究的重要基本素材，並盼有利於司法實務界運用時之參考。惟囿於人力、物力，蒐集、整編資料又極其艱困與繁瑣，本計畫之研究對象僅限於1928 年至1935 年期間的判例全文。
    During the period of the Nationalist Government, the subjects of the precedents of the civil and criminal litigation of the Supreme Court in each year was announced to the public but the full texts of such precedents were concealed. Neither the objective presentation of the basic facts nor the completed logic of the reasoning was lacked. Such lack hindered the thorough academic researches and enabled the conclusion revealed without the completed reasoning of the judiciary practice. The main purpose of this research project is to collect and further compile the full texts of the precedents of the civil and criminal litigation of the Supreme Court spreading in the country and in other foreign countries. In addition, it intends to construct the consequence of the completed facts of the production of each legal concept and the logistic formation of the legal application embedded in the trial practice of the civil and criminal litigation during the period of the Nationalist Government. The existence of this project will provide the fundamental and basic materials for the relevant academic researches and the reference to the judiciary trial. However, due the limited manpower and the subsidies, the full texts of the precedents collected and compiled will be confined in the period of the years from 1928 to 1935.
