    Abstract: 明治維新的日本，究竟運用哪些策略、手段，順利轉型為現代主權國家、引進現代法律秩序？一言以蔽之，可以用國體布局也就是當時所稱的國體論來回答。從最廣的國家戰略角度來看，國體論要解決的問題是：如何在製作現代主權國家、引進近代立憲體制的同時，能夠維繫日本獨特的天皇體制？這套將天皇視為「現人神」的國體論，經由下述三個環節的共構護持，成為鞏固明治國家天皇神勅主權、欽定憲法體制的基盤。它們是：(1)經由伊藤博文主導而在1889 年頒布的〈大日本帝國憲法〉、(2)透過井上毅推動而在1890 年頒制的〈教育敕語〉、(3)由穗積八束積極倡導的國體論憲法教義學。因此，本研究計畫預計以國體布局為主軸，分別探討上述三項環節的各自開展，希望以三年期的時間整合回答製作日本現代主權國家的權力系譜。各年度的子計畫題目如下：第一年：伊藤博文與〈大日本帝國憲法〉。第二年：井上毅與〈教育勅語〉。第三年：穗積八束與國體論憲法教義學。
