Title:	台灣人權實踐的軌跡和圖像——跨學科的理論及實證研究-重建刑事司法：一個人權批判的觀點(1/3)

Abstract:	刑事司法的原始設計是一種保障人權的機制，但此機制也可能導致人權的侵害。在近年來許多關於台灣戰後司法制度的發展與改革的論述中，人權的觀點與角度成為一個亟待面對的急迫問題。然而，在建立人權批判的觀點之前，我們首先必須回答以下的問題：這些論述如何看待人權？司法如何構成人權的侵害？其原因為何？司法保障人權功能的重要機制何在？我們應如何針對現狀提出人權批判的觀點，並且促成政策性的建議與改變？本計畫的目的有三：第一，分析刑事司法制度的歷史發展，並說明其與人權的相關性；第二，從人權的角度，考察刑事司法的現況並進行批判；第三，結合文化批評理論與批判法學理論，發展一個人權批判觀點。關於上述刑事司法制度之文化反省，包括：檢察權力的削減與檢察功能的發展、刑事訴訟制度的改良與事實認定的文化、檢察內部的透明化與民主化。此種文化反省需要一個理論框架，以便於說明司法過程對於人的意義，包括心理、社會、文化等層面。人權批判觀點的建立第一步為將法律放在社會語境中，將之當成政治與權力的事務。其次要重新整合法律、政治與權力的功能，必須如同法律現實主義所主張的，超越法律形式主義對於確定性的追求。同時，我們必須要認識到法律所具有文本性（textual nature），而致力於在敘事中揭露更多的現實，並尋求倫理的行動。本計畫將進行三年。第一年將致力於刑事司法發展歷程的分析，以及理論的初步探索；第二年將發展跨領域的合作，以及理論與實務的對話；第三年將與整合型計畫之其他子計畫共同研討，在理論上發展人權批判觀點，以便從事現實批判與提供政策建議。
