    Title: 菲律賓遣送我國詐欺嫌疑犯至大陸事件評析

    Abstract: 菲律賓政府於本（2011） 年2 月2 日不顧我國政府交涉， 執意將去
    （2010）年12 月27 日在大馬尼拉地區逮捕的我國籍涉及跨國詐騙人士14 名，
    連同其他涉案的10 名大陸地區人民，一併引渡至中國大陸。此一詐騙集團以菲
    律賓為基地，透過跨國電話詐騙中國大陸人民，受害者甚至涉及數名中共高官
    家屬，詐騙金額據瞭解高達1 億4 千萬人民幣，因此大陸強烈要求菲國依據雙
    方於2001 年簽訂的引渡條約，將涉案人全數遣送至中國大陸。我駐菲律賓代
    表處曾於菲國逕行引渡時，派員持菲國上訴法院簽發的人身保護令前往機場攔
    阻，但菲國相關部門仍堅持將14 名具我國籍之涉案人全數遣送中國大陸受審。
    我外交部門除在第一時間已透過各種方式表達強烈不滿與抗議之外，我海
    峽交流基金會（以下簡稱「海基會」）亦向大陸之海峽兩岸關係協會（以下簡稱
    「海協會」）提出關切，盼依《海峽兩岸共同打擊犯罪及司法互助協議》之機
    制，將涉案之臺灣地區民眾儘速送回臺灣受審。海協會則向海基會轉達中國大
    陸公安等部門之意見，盼雙方從有利於維護兩岸關係和平發展、有利於兩岸交
    流交往秩序和人民利益、有利於深化兩岸合作打擊犯罪及司法互助的角度，透
    過適當管道與機制與海基會持續聯繫與溝通。
    本文試就國際法、外交與兩岸關係的觀點討論該案，尤其是該案如何涉及
    敏感的兩岸定位問題；最後以該案做為教訓，強調兩岸應設法降低或管理無預
    警衝突的重要性，以利兩岸與外交關係的良性發展。
