    Abstract: 東海海域之重要戰略地理位置、特殊地質結構、豐富漁業與油氣資源，吸引各國覬覦。各國之間主要法律爭論在於釣魚台主權與海域劃界問題。二○○四年後，中國啟動油氣資源之勘探與開採，尤其是春曉油氣田，引起日本不滿，雙方因而展開一系列談判，於二○○八年達成「中日就東海問題達成原則共識」。此一「原則共識」難以被解釋為對雙方具有法律上拘束力之共同開發協議。儘管如此，考量臺灣對於東海海域所主張之權利，相關安排必須兼顧臺灣利益，才能有助於解決爭議，共創三贏。
