    Title: 國際法院認定科索沃獨立合法的解讀與啟示：俄羅斯與中國觀點之分析

    Abstract: 2010年7月22日國際法院對於科索沃宣布獨立，所表示的諮詢意見，認為此舉並未違反國際法。1對此結果，國際社會有贊同的迴響，根據科索沃總統府網站的統計，截至2010年5月19日，共有69國承認科索沃。2基本上，這些承認科索沃的國家，均屬認同國際法院看法的陣營。相對的，也有國家持反對的意見，可想而知，原先的「母國」，亦即塞爾維亞，隨即表達嚴厲的抗議，並決定採取連串的動作，持續反對科索沃的主權獨立。另外，尚有中國、羅馬尼亞、俄羅斯以及西班牙等國，並不認同國際法院的諮詢意見。而此些不贊同國際法院決議的國家，正巧就是目前不承認科索沃的國家。雖然，這些國家均宣稱維護領土完整的原則，3但事實上，對於科索沃獨立，未加以承認的理由，不一而足。4有的國家是基於宗教的理由，支持同屬東正教的塞爾維亞，例如俄國、羅馬尼亞、賽浦路斯以及希臘等。另有若干國家是由於本身國內仍有分離主義運動，譬如中國、俄國、印度、西班牙以及印尼等國。尚有某些國家，則是領土完整原則的忠實信徒，因此，對於從塞爾維亞脫離的科索沃，當然不予承認其獨立地位，諸如中國、巴西以及西班牙等其他國家。
