    Title: 層級化法律保留原則的適用

    Abstract: 一、釋字第443號解釋理由書所稱之「憲法保留」，應該是指憲法第8條的規定內容，不得由立法院以法律加以變更，而非要求所有人身自由相關事項必須保留由憲法規定。因此，應稱為「憲法優位」比較妥當。二、層級化法律保留在干預行政的適用，可以分成下列四種類型：1.最嚴格的相對法律保留（但並非絕對保留）：刑罰事項；2.嚴格的法律保留：行政罰、公務員懲戒及租稅等事項；3.寬鬆的法律保留；4.不適用法律保留之干預行政。三、層級化法律保留在給付行政的適用，可以分成兩種類型：1.相對法律保留：涉及公共利益或實現人民基本權利的保障等重大事項之給付行政措施；2.不適用法律保留之給付行政：非「及公共利益或實現人民基本權利的保障等重大事項」之給付行政措施。
