    Abstract: 本文旨在釐清管制治理的概念和發展，首先分析管制治理的理由和定位，除了說明公共利益研究途徑和公共選擇的研究途徑的差別。再者，探討民營化的管制和競爭，所衍生的議題核對管制治理的核心價值建構；並據此從管制治理研究的主要問題以及未解議題，來作為管制治理的省思，並據此來明晰一些國家間的差異。最後，本文認為政府管制體制改革應該成為公共治理的重要部分，唯有如此，才能在合理確定政府職能的基礎上，合理分配政府機關的管制治理功能，以及強化其管制能力。所以，吾人不應只是著重在特定的管制利益及目的，再者，也應注意不只是國家層級的管制，還應注意超越國家間藩籬的管制機構影響力。從英國的經驗來看，管制治理的興起不會只是因為民營化運動，也不會只是獨立管制機構成立即可，還應涵括政府內部整體管制的革新，才能形塑真正的管制型國家，才能有效避免現存文官之反抗。
