    Abstract: 國外不動產拍賣市場所拍賣產品多是正常不動產產品，拍賣市場參與者希望透過拍賣方式改善傳統不動產交易市場中買賣雙方搜尋成本過高所造成的種種缺點。而台灣不動產拍賣市場有別於國外不動產拍賣，其拍賣標的物為不良債權不動產抵押擔保品，拍賣目的不僅希望以拍賣方式改善傳統不動產交易市場之缺點，更重要的一點是能維護債權、債務人以及相關權利人之利益與公平。然而目前相關法令僵化的限制，卻使得不良債權不動產抵押品的出售拍賣無法以更有效率及更公平的方式達到目的，顯示現行制度有再檢討之必要。
