Abstract:	土地徵收,係國家因公共事業之需要,對人民受憲法保障之財產權,經由法定程序予以剝奪之謂;其性質,乃原始取得,係國家依法律為需用土地人取得新權利,同時被徵收人之權利,在與此不能兩立之限度內無形歸於消滅1。於是,徵收完成後,所有附著於被徵收土地之一切權利,不以所有權為限,尚包括其他相關權利在內,均歸於消滅。又,國家雖得徵收人民之財產,但基於憲法所定財產權保障意旨,應給予合理之補償。而徵收土地應發給之補償費,依土地徵收條例第十九條規定,係由需用土地人負擔,並繳交徵收執行機關之直轄市或縣(市)政府轉發。準此,私人土地為國家依法徵收,該土地上縱存有第三人之權利(例如:抵押權、地上權、租賃權等),其亦均將因徵收完成而消滅,並獲有補償;惟問題是,此等第三人之權利人應得之補償,是否即由直轄市或縣(市)政府直接算定給付?
