    Title: 再探媒體自律：從Luhmann的社會系統理論看「新聞自律」論述的有效性

    Abstract: 台灣在資本主義高度發展之下，商業力量取代戒嚴時期的政府力量進入媒體，也進一步導致了商業媒體日漸朝向煽色腥型態的媒體內容發展。在如此背景之下，傳播學界大多將重點放在自由主義與社會責任論的辯論之上，強調媒體身為「無冕王」以及國家的「第四權」，有其相應的社會責任，而社會責任的實行則必須仰賴媒體的「自律」。然而，對商業媒體而言，媒體自律約束其行為的效用似乎不大。那麼，為什麼會這樣呢？對商業媒體來說，媒體自律究竟是不是一個有效的論述？本文引用Luhmann 的社會系統理論對媒體自律的論述進行分析，指出對商營媒體來說，純粹的道德性自律很難達成。因為商營媒體同時具有社會公器與私有財的雙元特性，也造成了兩種不同運作邏輯的矛盾，在此矛盾之下，試圖以立基於純粹道德語言的自律論述來約束商營媒體的經濟邏輯思維是很難成功的，因此，本文認為，在目前台灣媒體私有化的結構之下，要使自律成為可能，需要更多面向的探討，不能以道德論述作為唯一的標準。
