    Title: 論土地徵收條例第51條第 2項未於規定期限內繳還徵收價額者不發還土地之適法性分析

    Abstract: 土地徵收與撤銷徵收對人民來說係財產權喪失與回復之一體兩面，前者為剝奪人民之財產權；後者為恢復人民被徵收之財產權。國家於徵收取得需用之土地後，對徵收所得土地之利用自仍受徵收目的之拘束，故於徵收目的不能達成之情形或不復具有必要性之情形下，自應辦理撤銷徵收，以將徵收所得之土地歸還予原土地所有權人。但撤銷徵收後之法律效果，依土地徵收條例第51條第2項規定，需由原被徵收土地所有權人於一定期間內繳還原被徵收之價額後，始予發還原被徵收之土地，若未於一定期間內繳還該金額者，則維持原登記依公產處理相關規定處理。此種作法無異將徵收土地之所有權存續保障與其所代表之財產價值予以相同地位之對待，彷若民事雙務契約履行上雙方債權、債務之對等性，是否已與憲法保障財產權有所乖違，曲解徵收時存續保障之優先性，實值得進一步釐清與探討。本文旨在對撤銷徵收時之法律關係及其原理進行分析、檢討，並以憲法保障財產權之意旨為基礎，檢視土地徵收條例第51條第2項規定之妥適性。
