    Abstract: 責任保險制度具有雙重功能：就消極功能而言，保險人必須依照保險契約填補被保險人因法律責任所致之財產損失，此與一般財產保險並無二致；就積極功能而言，保險人應本其專業協助被保險人進行和解，以求訟爭或衝突能平和落幕，達到保障被保險人心境安寧之目的。於我國現制之下，無論保險法或責任保險保單條款均無規定保險人應負和解義務。市場實務上，保險人於協助被保險人進行和解時，時有利害衝突之情形產生，甚至有不肖保險業者濫用其和解參與而藉故刁難，嚴重侵害被保險人之權益，有礙保險市場之健全發展。究其原因，實乃現行保險法相關規定有所欠缺。本文分析責任保險中有關和解之法律問題，並參考美國法制提出建議，期能成為未來保險法制革新時之參考。
