    Abstract: 本文研究二○○八年七月智慧財產法院成立後至二○一一年七月三年間法院受理之八百六十五則著作權相關案件，除試圖了解智財法院判決的主要傾向外，也檢視智財法院判決的效率並分析向該院提起著作權訴訟的實際效益。研究發現，智財法院審判相當有效率，且向該院提起著作權民事訴訟有一定的實際效益；但從該院受理的刑事案件幾乎是民事案件三倍，亦顯示權利人認為刑事手段遠比民事手段更為重要，而自然人定罪率偏低，亦顯示檢方有必要檢討對其大量公訴的妥當性。
