Title:	土地共有人優先承購權之行使

Abstract:	A有甲、乙兩筆土地，甲地係與B共有，應有部分各二分之ㄧ，乙地係A單獨所有。A於二○一一年七月一日與C訂立買賣契約，將甲地應有部分二分之ㄧ合併乙地，以一千萬元出售予C，並於同年八月一日通知B，告以是否行使優先承購權，B隨即表示願購買甲地應有部分二分之ㄧ，A答以須連同乙地合併購買。試問：何者有理由？
