Abstract:	智慧財產權保護提供之經濟利益的壟斷，一般認為能夠對創新發明活動，提供鼓勵的誘因，競爭法的執法則是以市場競爭的維護作為立法目的，因此，長久以來一直與智慧財產權法保持著一定的緊張關係`也引發了競爭法的執行是否會對事業的創新活動造成影響。以專利權而言，授權與否的決定自由是極為重要且核心的專利權內容，因此，專利權的拒絕交易在何種情況下應受競爭法的規範，即觸及了兩法域間的平衡拿捏。本文擬從競爭法的角度看看拒絕授權行為是否具有反競爭性，以及競爭法應對這類行為作如何的規範，是否會因此損及事業投入創新研發的誘因。內容上，係以專利權為主，但也會及於一些其他智慧財產權的討論，由於目前國內公平會對於這類案例的相關實務仍不多見，因此，主要是從理論面來敘述公平法的適用可能性，同時輔以外國法的比較，籍以作為我國執法的借鏡。
