    Abstract: 綜合以上的論析。本文基本上贊同本案法院以假設性授權磋商的方法，結合相關因素的考量，探求合理權利金以計算損害賠償。期待未來司法實務在新修正的專利法第九七條第三款架構下，以此模式處理相關損害賠償的請求。然而，合理權利金的考量因素的範圍為何？各因素的重要權數為何？各因素間應如何合計其相互影響的程度作出最終的計算？以上均有賴司法實務未來在解釋適用上提出完整的建構。
