    Abstract: 舉證責任法乃民事程序法中最為重要之問題,如法諺所云「舉證責任之所在,敗訴之所在。」足見舉證責任法則對於訴訟程序勝敗之重大影響。雖舉證責任法之理論牽涉甚廣,其中若干法則及概念,在我國亦均有待釐清,例如對於證明度之問題,究竟如何之證明度乃能符合所謂民事訴訟程序所要求之「確信」,而其與刑事訴訟程序者,是否有程度上差異?而其是否可對於舉證責任分配法則造成變動?有無其必要?均待更深入研究。另外,對於各種證據方法之調查,部分制度固已有文獻探討(例如文書提出義務、當事人訊問制度等);但對於證人之訊問程序,如何能更科學化及有效率化,則為將來為使訴訟法理論更具實效性所需面臨之問題。
