Abstract:	廣義之法律扶助制度固可包括民事訴訟法(以下簡稱「民訴法」)之訴訟救助、刑事訴訟中之指定辯護、法律諮詢扶助及訴訟保險等。其於人民之訴訟權、平等權、財產權等憲法權利有密切關聯,而與司法目的之實現,亦具有極為重要之功能。我國近來,因全國司法改革會議決議,為落實人民訴訟權之保障,强化法律扶助之功能,乃由司法院刻正著手法律扶助法草案;而在八十九年二月九日公布之修正民事訴訟法中,就訴訟救助一節亦有所增修,足見對弱勢者之訴訟權保障,於我國已逐漸形成共識。
