    Abstract: 本計畫預備對近二十餘年來,法哲學與法理 論(在我國也許可合稱為法理學)之發展重點做 一深入的探討.(尤其以德語世界為重點)一般而 言,法理學可區分為法概念論、法認識論、法 倫理學與正義論及法體制論四大核心部分.此 四部分分別標識了法理學問題意識與思考關照 的幾個基本面相,而且就其問題的成立與理論 的發展建立而言,有其內在的順序性與必然性. 簡而言之,問題的提出是以"法概念論"為最重要的出發點,但是問題的解決,卻落在法認識論往 法倫理學的銜接.本計畫的研究重點,即在於對 與此一問題脈絡密切相關的法論證理論進行深 入探討.尤其將以德語世界最重要的代表學者 Robert Alexy的理論為主要的研究對象.Robert Alexy 的理論一般被認為是近年來德國最具有開創性 與深度的法理論.以倫理學的論述理論( Diskursethik)為背景,Alexy對法論證結構進行了極 為精密的分析與建構.並且在其論證理論的基 礎上進一步發展了法規範、法溉念、法效力以 及基本權等理論.但是Alexy的學說也引起了廣泛 的批評與檢討.就法理學的角度言之,則以言說 倫理本身的可成立性,以及Alexy所提出之"特案命題"(Sonderfallthese)引發了最為熱烈的爭論.此 二大問題所涉及的理論層面既深且廣.第一個 問題涉及了倫理學的論述理論作為一種程序性 的理論,是否能妥當的回答規範的正確性問題, 也就是對其理性標準是否完備的考量.至於"特 案命題"是指法律論述是一般實踐論述的特殊 個案,這個命題涉及的則是"法理性",乃至於法 判斷合理基礎的可能性問題.在一年度的計畫 中自然不可能澄清相關的所有爭點,但希望以 兩篇文章將Alexy的學說要點及其與理論背景的 關聯做一介紹解析.
